Pregnancy discrimination act

Common Questions and Answers about Pregnancy discrimination act

Avatar f tn I would look up your human rights act and find what you can around discrimination in work. Take a copy of your human rights act to your boss manager and if she still keeps doing it maybe go to higher management. If all that fails do you have a workers union in your country we have a group of people dedicated to protecting workers rights. Someone like that may help or even try getting advice from a lawyer if there is none of this in your country. I hope things work out for you.

I had such a horrible pregnancy first trimester i was always náuseas, and would get sent home because i would be throwing up at work. Sometimes i felt sick before going and i would still show up if i couldn't take it anymore i would then tell them i was leaving. Atleast i showed up and tried to work.

13724114 tn?1440988803 I work for a law firm and can tell you without a doubt that they cannot. The Pregnancy Discrimination Act protects things like that and establishes pregnancy as a temporary disability, making it a protected class. If they were to do that it would be discrimination and you'd have a lawsuit, which they wouldn't want to risk.

Avatar f tn I'm 38 and got pregnant 2 weeks after starting a new job so I feel your pain. The Pregnancy Discrimination Act of 1978 does protect you. It means you can't be fired or otherwise discriminated against for being pregnant. In terms of leave, if your employer has any kind of short term disability benefit they have to offer that to you too. While you are out they can give away your job but they still have to give you a similar one upon returning. I went public at around 18 weeks with my employer.
178590 tn?1294180367 I don't think that they can fire you based on that you needing to work PT that is discrimination against pregnancy and they have to treat you same as someone who's not pregnant or like someone who has same abilities or limitations. There is a federal law called Pregnancy Discrimination Act (PDA) you may want to look this up, same as FMLA (Family Medical Leave of Absense).
13167 tn?1327197724 I ask this, because on this forum in the pregnancy webpages, and on this relationships forum, I'm so disheartened by how many women do all the work in the home, and pay all the bills while the men basically sit around and play video games and say rude things. Or they aren't even in the home, they get several women pregnant and demand that the babies be named after them although they have zero intention of participating in either providing money, or any kind of parenting.
Avatar f tn But how long should I wait to tell my new employer about the pregnancy?? Thus is baby number 6 and normally I was working with the others so I didn't have to worry. I'm a little nervous!!
Avatar n tn And I agree with the discrimination thing. Just think about the folks wth HIV and what a stink was raised about them being fired, etc. because of their diagnosis. Not like you're going to be giving anyone some of your blood any time soon. And any job where you are exposed to body fluids, ie if you were an EMT, you would be wearing the usual protective equipment (gloves, masks, gowns, etc.) to protect you and the patient.
1647475 tn?1363140697 I believe I also wrote a comment on this journal to indicate that I had filed a complaint with my company's Human Resource (HR) department and with the government's Equal Employment Opportunity Council (EEOC) to document and hopefully help fix all the discrimination issues my company was causing with me.
768015 tn?1333655675 On one hand you want the job and telling them you're pg may deter them from hiring you. (I'm not sure how the discrimination act works for pg women.) On the other hand you don't want to get hired and then spring this on them. I personally, though, would do what I could to get hired. Show them how well you do your job and then after a few weeks let them know you're pg. Hopefully by then they'll see you as a hardworking individual and wouldn't want to let you go when you have the baby.
2070825 tn?1337229569 I work as a cashier at Walmart and before I was pregnant, I had bad back pains and its even worse now. I'm halfway through my pregnancy and between all the pain I'm in daily and trying to control my hormones from all of the rude customers, I'm done! I can't take it anymore. I get one 10 min break every 2 hours when I work a full 9 hour shift and one 10 min break when they have me working 5 and a half hours.

Avatar f tn The Ledbetter Act responded to the Supreme Court’s ruling that Lilly Ledbetter, a supervisor at a Goodyear Tire plant, couldn’t sue her employer for two decades of pay discrimination because, they said, the 180-day window to file her discrimination claim began when her employers set her salary illegally, rather than each time she got a paycheck — meaning that by the time she discovered the pay discrimination she was out of luck.
Avatar f tn I'm really upset! Can this be discrimination? He told me I should just go under pregnancy leave I mean I do feel exhausted after all the hard work I put in... but to that extreme? Avatar n tn Just make sure you're really careful about insurance coverage if you do switch. I don't think pregnancy can be considered a preexisting condition but I'm not sure about that. Just be sure that you have COBRA in between changing and that your new insurance will cover you. Also, I don't what you should do about telling or not telling. I agree though, they won't likely hire you over someone equally qualified if you're preg and the other person isn't.

Avatar n tn there are virtually no documented cases of discrimination based on negative HIV test results; and if the result is positive, you will need to immediately get medical care, and proper health care for HIV cannot be obtained anonymously. Anonymous HIV testing made sense at one time, as a way of encouraging people who were hesitant about testing in the first place. But those times ended a decade ago.
