636290 tn?1224186146 I know of one case that was tried in Louisiana holding a hospital liable for transfusion of HCV. The case was lost due to the technicality of statute of limitations which is extremely unfair because how are you supposed to know if/when you received the virus? In my case I received the transfusion in 1982 and went to doctors for 25 years complaining of illness before it was diagnosed in 2004.
Avatar m tn Generally it is 3 years from the date of arrest but there are many exceptions. For example the statute of limitations for fraud is 4 years from the discovery of the fraud. In a serious felony the time frame can be much longer than 4 years and for the most serious of crimes, murder, there is no statute of limitations. That's why cold cases can be filed years or even decades later. Anyways, that's probably too much info :) It sounds like with your wife it would only be a misdemeanor.
1347290 tn?1276553091 What you are referring to is the statute of limitations, and this varies from state to state. Many states are now changing their laws so that the statute of limitations extends for one year from the time that DNA evidence is introduced (this is thanks to science). According to CA Penal Code State Statute 803, "Notwithstanding the limitations described in section 799-801.1 of the Cal.
Avatar m tn You are exactly correct, it may take a long time before one knows the extent of any damages and/or any grounds to sue. The statute of limitations to bring a lawsuit is to provide enough time to establish a viable claim for the plaintiff. And the other side of coin to have a longer statute-of-limitations would/could unfairly treat a defendant. Good luck and take care.
Avatar n tn Hi I had a crown on number 19 put on and it has been 7 months, it is still bothering me also. I went back to the dentist 4 times and he states there isn't anything wrong with it and that it would pass the dental board. It feels like it keeps sinking deeper yet into my gums. It gets irritated when I eat. I am debating whether or not to contact the dental board and put in a complaint. I don't understand how a crown could hurt for 7 months and nothing be wrong with it.
Avatar n tn Just a guess, but since your daughter is now 40, it is possible there is a statute of limitations that has passed. You do need to ask an attorney.
Avatar n tn I have the same symptoms. I went to a Neurologist and he told me that I had a ruptured petrusion and that if I didn't have surgery 50/50 chance he said to wind up in wheelchair. I have been active my whole life and worked even as a child but when you have numbness and pn,can't sleep, or do anything for that matter w/out paying for it. I had the surgery in which they put 2 titanium plates in my neck.I had a C5 diskectomy and was told later after suffering for 3 yrs.
Avatar n tn i too am going through peer review in new york state- it has been 10 months of the process out of a 30 month statute of limitations. i was actually granted an appeal, and am awaiting round 2 of peer review - i have 32k in botched work in mouth, want to have it redone at the dawson center in florida. if i were you, go to the office of professional disciple, have his licesc]nce sanctioned. they are all a huge bunch of liars- dentists can be total losers- i have seen at 6 that qualify!!!
Avatar n tn You can also notify your county dental society to see if he will pay to have it redone if you do not want to go back to him, but first check your statute of limitations, this is the most important thing of all.
Avatar f tn My apologies, my phone keeps trying to autocorrect my grammar. In the State of Florida, Medical Malpractice's Statute of Limitations is 2 years from the date of Discovery. - every state is not the same, so I would research your area.
Avatar m tn 1.) My left eye has a gray circle in the vision, which I am guessing is a macular hole, but I have seen a retinal doctor many times and he hasn't said anything about working on it. 2.) I also have blue circles/flashes of light when my right eye moves to the extreme left or right, again, the doctor says nothing about it. When I first saw him because of it he said it was the vitreous pulling, causing the blue flashes. Then it went away, and is now back. 3.
Avatar f tn if ur worried only about legal issues i believe the statute of limitations ran out so that isnt a concern.
Avatar f tn If you do decide to see a lawyer, look for one who has handled malpractice cases a lot, and get a realistic assessment of whether you have a chance to prevail before you put a lot of money and time into it. Also, be sure there is not a statute-of-limitations issue.
Avatar m tn So far, lawsuits have focused on Accutane and birth defects, depression and suicide, ulcerative colitis and Crohn's disease. Eg: "Accutane Lawsuit: Andrew McCarrell Wins $25 Million After Having Colon Removed." No mention of Accutane associated with hypothyroidism. Good thing you only took the drug for three days.
Avatar f tn I think the only thing that will go away in time is the statute of limitations. No where in any literature, on the DVD or from my doctor were any of these side effects EVER MENTIONED! The lens is a ReSTOR lens. Is there any help for me? I am a commercial artist and this is now affecting my ability to make a living.
Avatar f tn Twenty years from what i understand is beyond the statute of limitations the only thing you can probably do is file a complaint with the medical board. I am totally not sure on this tho.
Avatar m tn Find an attorney soon as the statute of limitations sets time limits for how long you have to pursue a claim. What was your original surgery on your right ear for, you never said? Good luck babydoll hang in there!
Avatar f tn Please do some homework and possibly be ready to hear some really bad news, permanent news. The Statute of Limitations is ticking away, and you may have only 12 months in which to sue your LASIK surgeon for permanent injury. You may ask an attorney about this and ask if you should compile recordings of conversations and medical charts that may one day come in handy in court. www.LifeAfterLasik.com www.LasikAdvisory.com www.LasikNewsWire.com www.LasikDecision.com www.LasikComplications.
404138 tn?1308941656 Anxious, these are legal questions. "Rape" does mean sexual penetration. It can be statutory (sex that was consensual but one party isn't old enough to give legal consent) or can be forced sex between adults, or an adult or a child. Being forced to touch someone against your will can be called Lewd and Lascivious behavior, sexual assault, sexual contact with a minor, etc.
Avatar m tn Hi here is another person who is asking about law suits and lawyers advising. her to consult a specific type of lawyer. I think that there is a statute of limitations. The first lawyer said there are lawyers taking on these cases but you have to contact them. I think as soon as people find out about them they are inundated. On the site, "informed consent" is mentioned. Also having medical records to prove that it is connected. Good luck. http://www.avvo.

Avatar n tn I'm not sure; but you may need to get in touch with someone about the meridia situation, but be careful what you post or say just in case they check on you - and if you find you do have a problem lawyers will check it out - and what you say or post can and will be used against you, so just be cautious. Having said that, I went through a similar thing as you - I took Phentermine for the first time in 2006, it worked so I went to my dr over 4-5 years and did a program 3 separate times.

1301089 tn?1290666571 So, we have a Justice Department that drops a case it already won against New Black Panthers who are on tape intimidating voters in blatant violation of federal law, but that sues a sovereign state for enacting a statute in support of immigration enforcement practices that have already been upheld by two of the nation’s highest courts. Perfect. http://corner.nationalreview.com/post/?
Avatar f tn Precisely how does application of the statute to the protected activities help achieve that important security-related end," he asked. Since the September 11, 2001, terrorist attacks against the United States, federal prosecutors have pursued "material support" cases against at least 125 individuals or organizations, winning convictions in about half of those cases. Nearly every domestic terrorism-related prosecution has included the charge as part of the indictment.
352007 tn?1372857881 I have learned today for the very first time, how limited my fine motor coordination is. The ordeal started with me attempting to unscrew a screw from a pair of reading glasses, taking me HOURS to place the edge of the screwdriver into that tiny little line. Then it was the turning and pinching while turning scenario which made me drop the screwdriver over and over again. I have punctured my opposite hand's fingers multiple times bleeding like no tomorrow. I sat there and cried.
19182206 tn?1473569735 Mandi - I'm so sorry for your condition. The best thing for you to do now is to eat and drink a non-inflammatory diet. Also, you might want to see a neurologist. New imaging techniques have been developed to document the brain damage done by interferon. It may warrant disability. Somebody needs to bring a lawsuit. Part of the evil of INF / RVN is that it utterly incapacitates you and fries your brain while the statute of limitations on your case runs out.
