Managers would take gratuity off just cause customers complained that it was on there, and it was noted on menus and receipts that a certain percent would be added...so it's not like there wasn't a written warning about it. But being arrested because they were "stealing" from the company? They're not stealing in my opinion...now if you wanted to add a tax for group size because they're taking up tables and preventing the company from making money that's one thing.
